Employment tribunal awards
If you have been successful at an employment tribunal but have not received the payment from the respondent, a Fast Track scheme to assist you with enforcement is available.
Following government research in 2009 which showed that a shocking 39% of those with an award had not been paid at all, and only 53% had been paid in full, a new Fast Track scheme was launched by the government in April 2010.
Since this date, as soon as a respondent has defaulted in payment of the award, you can complete an Enforcement Form and send this to Registry Trust Ltd (RTL) together with the documents mentioned on the form. There is also a court fee of £60 (please provide a cheque made payable to HMCTS) required which is added to the amount the respondent already owes.
High Court services
High Court enforcement is the fastest and most effective form of enforcement in the UK. By transferring up your court order for enforcement as a High Court writ, we recover the money owed to you by the debtor under the judgment and pay this money back to you quickly.
Marston is the UK’s leading judicial services Group, recovering more monies for High Court clients than anyone else. When traditional debt collection methods fail, our expertise as authorised High Court Enforcement Officers enables us to prompt immediate engagement from individuals or businesses that have been ordered to pay money, return property or vacate land. If you have a High Court judgment less than six years old that has failed to be enforced, even by another provider, we can also help you with our High Court returns service.
High Court returns
Turn your un-enforced writs into real results by sending us your High Court returns. We provide two ways to convert these would-be write-offs into money recovered – at no additional cost.
This year as many as 40% of writs issued by the High Court will be declared un-enforceable, left to expire and be written-off. In many cases, this is because a customer has moved away and cannot be located.
Whether absconding to avoid enforcement or absent for legitimate reasons, tracking down these customers can be time consuming and expensive, leaving a large number of writs that continue to be returned.
Quite often, absconders reappear relatively quickly. So having a market leading tracing and investigations division and a nationwide field force of certificated enforcement agents makes it easy and cost effective for us to check.
